EPA Flexing Its Muscle

It seems that the $600 you spent to get certified and registered with the EPA to work in 1977 and earlier homes is now going to pay off.

If you are a remodeler, contractors, or building trade (electrician, painter, plumber, carpenter) and happen to be working on your own or through another contractor on any home built prior to 1978 homes, you should already have your certication with the EPA under the "Lead: Renovation, Repair, and Painting" rule. If not, get it now!

The EPA is stepping up its enforcement of this rule and particularly looking for uncertified contractors (per this rule) or those sloppy with keeping and filing out the right paperwork. Fines are very stiff.

While the incidence of lead paint is very slight, the penalties for ignoring this rule are huge. If in doubt, assume any structure built prior to 1978 has lead present even though many do not.

Better safe than sorry while this rule remains in effect.

Realtors and homeowners should know that this rule adds several hundred dollars to any remodeling job just for the compliance.

You have to have been chewing on lead pain for many years to believe this is anything, but a tax.

That said only those paint eaters should risk getting caught with their forms down.

Steve, I heard the fine for not following removal and disposal guidelines was huge.  In some way this is really over kill.  Most home owners simply paint over it.

I believe the fine is $30,000/occurance. According to the officials here: Any remodeling done, whether a contractor is involved or not.

I actually got certified under this law and have the Certified Renovator ID card.  Complying with this law is not for the faint of heart.  You are required to put down plastic covering everywhere, seal off doorways with tape and plastic, wear HAZMAT type suits from head to toe including a breathing apparatus, use EPA approved vacuum cleaners to suck up paint chips and dust, and then discard the mess in special bags.  It will cost several thousand extra dollars to comply with this law. 

Just another reason the EPA and all its rules needs to be dismantled.

And then after you go through all of these exhaustive measures, you throw everything in the trash to be taken to the landfill. EPA must go, along with Energy, Education, and Labor. :)
