Can Eric Holder Be Sued For Specific Performance?

Is Eric Holder spiteful, mean, or clueless? He has announced that he is considering filing a second lawsuit against Arizona and their SB 1070 immigration enforcement act on racial profiling grounds if the act goes into effect. That doesn't even make sense.

First the law hasn't even gone into effect. Second, the federal law is stronger than the Arizona law anyway. Thrid, the claim is baseless since no actions have been taken. Then add to that the fact that the feds are forcing the people of Arizona to spend their tax dollars to defend a frivolous lawsuit - or two - brought by Holder.

I guess he and Obama are just sore that someone is actually trying to enforce a law that they don't want enforced. What was that about upholding the Constitution (which included enforcing the laws of the land)?

Can we sue him - or both of them - for specific performance to make them do their job?

I recall reading that seven law suits have been filed already. What a waste of money for everyone.

Why not spend the money that will be spend on the lawsuits for things like more border patrol, fences, and even for our schools and parks that are all closing because the state is going broke? Its all just crazy. Thanks to those in other states who are supporting us here in AZ.

Steve - it is interesting that when announcing the suit Holder talked about the failure of the federal government to act as a key catalyst for the law. Sounds like the feds should be sued for specific performance. Will Holder now sue Rhode Island which has similar practices to the Arizona law? Oh wait, I do believe that SCOTUS might have upheld Rhode Island's practices. And will he sue San Francisco and other so-called "sanctuary" cities that have statutes that are absolutely contrary to federal law.

I believe that taking the oath of office to uphold the constitution and laws of the U.S., and then taking the side of a foreign country (Mexico) when a state tries to enforce the laws, is an impeachable offense.

May be Holder hasn't gone after Rhode Island because is usually tracks liberal, even though they have a republican Governor right now.  If I remember correctly Arizona leans conservative.  I wonder if this has anything to do with their mind set.

I don't think Holder could be sued... he certainly could claim Obama as the source of the orders he is following...  But could Obama be sued for failure to uphold the law he is sworn to defend?

obama needs to be made responsible legally for his crimes of not upolding the laws of the land.  As someone else stated, he is in direct violation of the Constitution by 1) siding with Mexico over Arizona 2) encouraging illegals to remain here and in fact HELPING them to STEAL from the American Citizens.
