Arizona passed SB 1070 because Eric Holder and the feds refuse to enforce the existing federal law. They took matters into their own hands, crafted a law very much like the federal one, and gave police the power to determine if someone was in this country legally if their suspicion was aroused after a lawful stop on another issue. The federal law saw an immigration officer can stop anyone at anytime without a warrant and without cause. Seems like the Arizona law is much better in this regard.
The Arizona law is effective at the end of this month. Holder, since he won't enforce the federal law, doesn't want anyone else enforcing such a law either.
Holder has filed suit in federal court in Arizona to block the enactment of SB 1070.
Many think the feds will prevail on Constitutional grounds, but if the feds are unwilling to enforce a law they are sworn to uphold, and we can't sue or impeach them for failure to do so, then the Arizona law should be allowed - and so should those of all the other states, border or not.
Maybe the federal judge will demand that the federal law be enforced in exchange for vacating the Arizona law. That would be very sweet justice.

Steve.. I am guessing that the Federal Government, if they win, Won't enforce the law againt the state of AZ either. Of course, that would make sense and they would not want to set a precedence.
Will the feds sue the cities that are sanctuary cities? They are in conflict with our immigration laws, and I consider it aiding and abetting criminals. Maybe it's time to impeach the mayors of these cities on this basis.
The fact that the Federal Govt. is taking this action blows me away. Who was the last president to sue a state? And its not about race people, race was not in the suit.

Steve, the current laws in place allow for law enforcement to make arrests for illegal occupation in this country. Regardless of the examples that are put out, if the person does not have legal documentation, that is probable cause for detention until the officer has enough information to make a decision as to who the person really is. It doesn't matter what you look like either. So all of this is about nothing in the end. The federal government must enforce the laws on the books. AZ. can lose and still go about their business. The problem is that the government won't take possession of the person and will not deport them. So local law enforcement is limited to writing citations for the person to show up in court. Tens of thousands of citations have been written, only a few have shown up in court. It is a sad day in America.

Eric Holder, Hilda Solis, and most Members of Congress need to go for this willful disregard of US law. Follow that up with the President. :)

It will be interesting to see how the case comes out. There are some that are saying that the Constitution might actually go in favor of AZ. The law is not contradicting federal law, and is not making new policy for the federal government. In actuality, the 'Sanctuary City' laws ARE unconstitutional... and there would be plenty of precedent for the federal government to go after them.
