It is a crime - meaning illegal - for anyone to knowingly employ illegal aliens. Therefore, employers are mandated to check for proper documentation before hiring anyone and to ascertain that anyone hired has a legal right to be in this country.
The "Immigration Reform and Control Act of 1986 ("Simpson-Mazzoli Act") and the "Federal Immigration and Nationality Act" (Section 8 USC 1324) makes it a crime to employ illegals, but there are other provisions.
"It is a violation of law for any person to conceal, harbor, or shield from detection in any place, including any building or means of transportation, any alien who is in the United States in violation of law. Harboring means any conduct that tends to substantially facilitate an alien to remain in the U.S. illegally."
Here's where Secretary Solis and her employer, President Obama, run afoul of the law - and Attorney general Eric Holder for that matter for being complicit and not stopping it.
Solis has a PSA that encourages workers - "documented or not" - to reach out to her if they feel they are not getting paid fairly and her office will help them get the money that's coming to them.
If they are illegal, they are not entitled to any money because, by law, they cannot be employed.

If I was an undocumented worker I would be a bit nervous about that one. Around here we have had quite a few border patrol busts over the last few years.

I understand the thought behind the sentiment, but disagree with the way it is presented. If illegals can't speak up about working conditions, they will be de facto slaves... HOWEVER, they are here in violation of the law! They need to leave.

I have rather mixed feelings on this. Although I believe that there should be mandatory jail time for anyone who hires or rents to an illegal this is simply not the case. The government(Both parties) just about invite the illegal workers into the country . For the republicans it is a cheap work force and for the Dems they are political supporters. Calling immigratio to reprt an illegal worker is about as usefulas listening to Nancy Pelosi tell us about the finer points of christianity
If we arwe not going to deport them than I say they should be treated with decency and humanely. If employers were actually caused to pay them a living wage maybe we wouldn't have to hear about the jobs Americans supposedly dont want. Americans just want to be able to provide for their families. Having an underground workforce working for substandard wages makes that nearly impoosible. Don't get me wrong, I would gladly drive the bus to start transporting them back into their own ountries, but until our government is ready to start actually enforcing the lawthese are still people we are talking about. They are not illegal if the arent breaking any laws and as long as the laws are disregarded by our own govt. how can they be broke.
what is frustrating to me is that deporting 20 million undocumented workes would go a long way towards fixing what ails thiscountry, in the areas of unemployment, healthcare and social security we don,t have any leaders with the backbone to do what needs to be done

It is clear to me. They are illegal. It matters not what they are doing today or how well they are doing it. They snuck into this country - ahead of or in place of someone who tried to do it right. Either we are a nation of laws or we aren't. It is shameful, and criminal, for the Administration to condone and be an advocate for illegals. :)

I have to disagree with Georgia. Many of them are stuck here because of their desire to come here for economic freedom. The 'Coyotes' often threaten to hurt other family members if their 'customers' don't work for them.
The best way to stop this insanity is to make it uncomfortable for employers to hire them, and for them to come here... FairTax would add burden to them... while letting them pay their way a bit more by not allowing them the Pre-bate.

Lane I highly respect your opinion. Looks like we are at odds over this one. It is true that I lean towards TOTAL RESPONSIBILITY for all personal decisions. Many people will give exceptions for other peoples poor decisions. I think that only encourages more people to make the same poor decision that IMPACTS INNOCENT FOLKS who had NOTHING TO DO WITH THE ORIGINAL BAD DECISION.
As a Nation we are failing. Badly. Our very existence as a Nation will be tettering if we continue on the current path. Should everyone have to "pay" because we are unwilling to make sound, tough, decisions? I certainly hope not.
As far as anyone illegal being "stuck here"? No they aren't. They CHOOSE to come and they CHOOSE to TAKE and they CHOOSE to stay.
The only way to stop them is to take away the incentives that bring them here.

Georgia and Steve... that isn't what I mean by 'stuck'. There are people that have come here thinking that they would be free... though illegal... and have instead ended up as defacto slaves to their 'importers'. They really are trapped. Either they are being held here, or there are pending threats against their family back home. If they leave they risk their lives or the lives of their families.
I still think that we need to start by disincentivizing employers and prosecuting heavily all of the people we find smuggling aliens across the border... and tightening the border in a big way (ok, make it easy to sneak back...).
