Vote Down Balanced Budget Amendment

The House will vote on the balanced budget amendment to the Constitution tomorrow as scheduled. It needs 290 votes to pass and is not expected to get them. That's fine with me. It shouldn't pass.

Why do I say this? Am I for more spending? Absolutely not. I'd slash the the current spending so that there was blood figuratively flowing from the Capitol. That's how you control spending - not with a meaningless and unenforceable amendment.

The Constitution has been amended 27 times - 11 from the the Bill of Rights (yes 11, not the 10 that you might have been taught). That's several more than we need already. Didn't need the 16th, 17th, or 18th - and the 21st was used to correct the 18th.

At any rate, if the amendment were ever to be passed, who would enfore it? Congress? The Courts? Didn't think so. Why tack on and encumber our Constitution with more words that mean nothing?

Cutting spending is very simple - but not for politicians. Over half of the cabinet departments can be eliminated or severly cut back. Consolidation. Attrition. So many ways to save money. That's how we balance the budget - we just do it.

Of Course, It's Unconstitutional

Whether the Supreme Court finds the health care law unconstitutional next June when it issues its ruling, it clearly is. The federal government cannot compel anyone to buy anything - flags, insurance, books, food, or anything else. They simply don't have the power. We the people didn't give to them.

I know that some try to make the argument equating auto insurance with having health insurance. There is a huge difference. We have a choice on whether we want to own and drive a car. It's not mandatory. We can use public transportation, have a family member or friend drive us, walk, ride a bike, or make even other arrangements.

If we choose to drive, the state - and not the federal government - says that we have to be insured. Some people ignore this and drive anyway.

We do not need to have health insurance. We can pay for our treatment as we go. We can refuse to be treated - regardless of the seriousness of the condition. We can get family to help us for unusual or larger than expected expenses. If we are involved in a catastrophic accident or major illness without insurance, collectively others have to pay for that. But don't people without kids pay for schools? Don't we all pay for welfare? Don't we all pay for most government services whether we use them or not? Not a real strong argument to say that everyone must pay their own way when there is all this precedence against it.

There is a huge difference in requiring auto insurance if you want to drive and health insurance because there is nothing attached to it as a sufficiency. Even requiring people to have homeowners insurance or flood insurance is only applicable if there is a lien holder. Otherwise, it can't be mandated.

Let's hope that the 5-4 vote on the Supreme Court supports what most of us already know. It is unconstitutional.

The Constitution's Validity Hasn't Changed

Goodwin Liu has been nominated for the US Court of Appeals, but his nomination should be rejected. It's just plain bad for business.

He has said that we can't interpret the Constitution by what it meant in 1789 or 1870 - that it has to be in line with current times. He supports "bending the meaning and even revising the text" of the Constitution to meet contemporary needs.

This is the trouble with so-called social justice and legislating from the bench.

If the courts really were empowered to make things up as they went along to address whatever deficiencies or shortcomings they felt were at issue or to bring the Constitution into the current time, the Founders wouldn't have written Article V as they did. They just would have given this power to amend the Constitution to the courts.

The Constitution only gives Congress 17 specific powers. They hold true today as much today as they did in the late 1700s except that the postal service is pretty much a nonissue and Congress has abdicated its right to control the money supply to the fed. The executive cannot do most of the things it is doing, and the judiciary is way out-of-bounds.

Many people feel the Constitution does not address - and the Founders could not have foreseen - health care, internet, csars, cap and trade, and many other contemporary issues, but this is not true. By firmly giving all power to the people - except a very small amount the states carved out for the central governement, most of what is being talked about and passed in Congress is simply not permissible.

The Founders felt that health care was a personal responsibility. Internet is a type of speech or press - both guaranteed to be free. Congress has so expanded the "Commerce Clause" as to include most anything government wants to do. Liu wants it even broader.

Fortunately his 60 votes aren't assured in the Senate and he should be defeated.

The Constitution is very clear. Like the Bible, it's not that people have an issue with what they don't understand. It's what they do understand that bothers them.

Happy Constitution Day

Did you know that our Constitution had its own day? Well, it's today. On September 17, 1787, it was approved by the Continental Congress and sent to the States for ratification. It's a federal observance.

The Founding Fathers had a great vision. Only a few of the 27 Amendments have really been necessary. Most are just for clarification. A few were mistakes - by us, not them. They tended to give the American people - and politicians in particular - more credit than apparently was deserved.

With November 2nd now only 45 days away - a month and a half - the Constitution is looming even larger as the focus of this year's vote. Many so-called Tea party candidates and other conservatives are attracting a big following from those of us wanting to return to our foundational roots.

The Constitution is an awesome document. It's easy top understnad. It was writtten for the farmer and the common citizen. It does not need a legal scholar to interpret it or a federal judge to add to it through their rulings.

Happy Constitution Day everyone, but especially to my fellow patriots!

Annoucing New Conservative Active Rain Group

The U.S. Constituion is the "Law of the Land" so the name of the new Active Rain group is "The Law of the Land."

This new group complements other groups such as Silent Majority, Celebrating Free Enterprise, and Tea Party.

Any issue - immigration, gun rights, free speech, freedom or expression, freedom of religion, Supreme Court nominees, Congressional actions or agenda, Presidential actions or agenda, and the like - that impacts or addresses the content or spirit of our Founding document of the Founding Fathers is up for discussion on this site.

Any action by an appointed or elected body or individual that usurps the Constitutional authority of another should be pointed out for the benefit of the group. This affects our livelihood and the fabric of America.

This is a conservative site that adheres to the majesty, foresight, and comprehensive of the orginal document although all points of view are welcome within those guidelines.

On this Independence Day weekend, it seems an appropriate time to launch this site and offer another place for patriotic Americans to post.

Our Constitution Now Comes With A Disclaimer

Did you know that the Constituion should be rated PG-13? That it is not suitable for young minds? That it's out-of-step with today's liberal society?

These are not my views. A publishing in Radford, Virginia - A & D Publishing - is offering the Constitution, the Declaration, and the Articles of Confederation in a single book with the following disclaimer:

"This book is a product of its time and does not reflect the same values as it would if it were written today. Parents might wish to dicuss with their children how views on race, gender, sexuality, ethnicity, and interpersonal relations have changed since this book was written before allowing them to read this classic work.

So now, the Constitution is no longer safe for children to read. It might give them the wrong idea about their country.

All I can say is that it's a good thing it was witten in the 18th Century. It would be thousands of pages if was written today - possibly multiple volumes.
