Is Congress Developing A Backbone?

Finally, someone in Congress is willing to take on the Administration and rein in the unconstitutional quasi-legislative function of some of the bureaucratic agencies. The target this time is the FDA. The EPA, DOE, IRS, and many others should be next.

Rep Stephen Fincher of Tennessee wants the FDA to come under Congressional oversight and become accountable - as it should be. No more making up its own laws and rules and then promulgating them. The Congress is the only one with this power but they have abdicated so much authority to the Administration over the years.

Time to get that separation of powers thing working again.

Congress Needs To Reassert Itself

I am so tired of the unconstitutional Executive Orders that the White House and its Departments have been using to circumvent the Congress, the Constitution, and the will of the people. The actual intent of the Executive Order, which has been around for over a century since 1907, is to allow the Chief Exeutive to govern the Executive Branch. Consider them as official memos on protocol and administration. That's the intent although not specifically provided for in the Constitution.

Now for the abuse of power.

The Congress is being intentionally sidestepped, and the Executive Branch is now legislating. So much for checks and balances. and separation of powers. Where is the Supreme Court on this? Where is the Congressional ire?

The EPA can write and promulgate regulations on emissions, lead paint, and energy efficiency. The Department of the Interior now has reversed an Executive Order of President Bush and gives the Bureau of Land Management the power to regulate government owned lands, including designating some as off-limit wilderness areas. The move is heralded by environmental groups but is acknowledged as doing something that only Congress is authorized to do.

The curbs on communication and internet that the FCC is proposing and authorizing is yet another example.

We must demand from the 112th Congress that they call the White House on the abusive us of unconstitutional power and put the checks and balances back into the Constitution.
