Two challenges to Obamacare begin today.
In the Senate, they are taking up the repeal of the 1099 provision that makes every business supply a 1099 top any merchant forrom which they purchased $600 or more of fuel, supplies, materials, proeprty, or services. This is set to begin in 2011 and be in full force by 2013. Think of the impact, the paperwork, the expense, and the waste. This has what to do with health care? That's right, nothing - but it's in the bill. One of those little surprises pelosi said we'd have to read to find out.
in federal district court in Pensacola, Attorney General Bill McCollum and 19 other states are bringing suit against the government on 2 mandate provisions of the bill - challenging the constitutionality.
For whatever reason, no "severability clause" is in the bill so it can all fail if the court finds in favor of the states. I find it unconstitutional on its face, but will accept any defeat of it that comes about.
This could make its way to the Supreme Court, or the the next Congress could make it easy and just repeal it with enough votes to override a Presidential veto.
