When Amendment Provisions Collide

Florida recently passed a bill and Gov. Scott signed it that prohibits peditricians from asking children if there are guns in their house. The doctors are upset - claiming their right to free speech (First Amendment) has been curtailed. How about the patient's/family's rights to free speech to not answer their invasive and inappropriate questions?

I have never been asked such a question by any doctor, and my children were never asked such a question by any doctor when they were younger. I would be extremely offended if a doctor had asked such a question because it insinuates that the child was being placed in a dangerous situation.

The Second Amendment gives everyone the right to own guns - whether they choose to or not.

So doctors should just assume that everyone has one and if they are concerned about children in a home with guns, provide a pamphlet on gun safety rather than trying to play social worker. 

This bill is good for parents. Even if there are guns in the home, why are doctors trying to imply that the home is unsafe?

It's Still Illegal To Ride No-Handed In Florida

In the recent legislative session in Florida, some bills were considered to rectify laws on the books that were outmoded. One such law is to rescind the moving violation for coasting down a hill in neutral. That was worth a $60 fine. Now it's OK to coast except that Florida doesn't have that many hills.

Sticking with vehicles, the Senate passed a bill that "decriminalized" riding your bike without at least one hand on the handlebars. Probably a good idea unless you're a very good rider, but illegal? It carries with it a fine of $56.50-82.50 with court costs. The fine itself is $15. The Senate passed it. The House let it die without consideration. Seems like this would have been simple enough to pass.

So if you're visiting Florida and want to go for a bike ride, remember to keep at least on hand on the handlebars at all times - at least if you're in public where people might see you.

Another Strike Against The EPA

The EPA is arguably an unnecessary agency and a colossal drain on the national budget.  It makes rules at its own discretion. Eliminating the EPA or certainly curtailing its budget would go a long way toward solving the debt crisis we have in this country.

To that end, the Florida House is doing something about the EPA's power. It has passed legislation to prohibit state, regional and local government agencies from implementing federal water pollution regulations.

HB 239 passed easily. The EPA has designed rules to reduce algae blooms that they say are choking rivers, lakes and other water bodies in the state. Agriculture and business interests as well as many local governments oppose the rules, arguing they would cost billions to implement.

The Senate has a similar measure (SB 1490) is stalled in committee. Get on with Senate and pass it.

Florida Considering Relaxing Rules For Development

The Florida House is considering HB 7129 today, with a roll call vote scheduled for tomorrow. At issue is whether to relax some of the rules for urban development. A similar measure is proceeding through the Senate.

This would cut out some of the red tape and let economic development move forward.

Of course environmentalists are worried that this would harm Florida's natural habitat and create urban sprawl.

However, they are forgetting one thing. There is no development in Florida - South Florida anyway. Builders can't get AD&C (acquisition, development, and construction) loans, and developers should have learned from a few years ago that there are a limited number of buyers. Just building it doesn't make it sell.

Anytime government relaxes or eliminates regulation is good. In the end, economic factors will dictate what works.
