How Did This Happen?

The US Treasury Department - not specifically provided for in the Constitution but the one that prints money for Congress, hosts the IRS for Congress, and houses the Secret Service - posted long awaited new travel guidelines for visiting Cuba. Since when did the Treasury Department enter the transportation business? When did they assume the Congressional role of regulating international commerce?

Unless Congress was completely asleep when this happened, it doesn't seem like Treasury was within their scope to do any of this. And if by some fluke someone in Treasury in the past convinced Congress to let them do this, it needs to be stopped now.

Congress does very little of what it's supposed to do in the Constitution, which means that nearly everything it does is by its own pleasure and volition.

Congress only has 17 things it is allowed to do - not that hard to determine an agenda based on this.

Let's Hold Congress Acountable

With the 112th Congress set to convene on Wednesday, "we the people" need to take a much more active role in holding them accountable. We were steamrollered in the 111th Congress. They passed things which clearly are unconstitutional. The Constitution does not provide for or even allow Congress to pass - or even debate - much of what they spent their time doing the past 2 years.

Congress has only 17 enumerated powers plus an 18th enabling clause. The "general welfare" clause is much abused provision, and Congress has used this cover rationing of health care, the school lunch nutrition bill they just passed, cap and trade, Stimulus bills, TARP, the buyouts of GM, Citi, AIG and others, regulation of major league baseball, anti-trust regulations, and so much more.

If they spent their time on what the Constitution demands of them, they would be plenty busy, and we'd be much better of for it. Our economy and jobs would flourish.

From Article I, Section 8 of the US Constitution, here is what Congress can do (capitalization and spelling is as found in the document):

(1) "The Congress shall have the Power to lay and collect Taxes, Duties, Imposts, and Excises, to pay the Debts, and provide for the common Defense and general Welfare of the United States, but all Duties, Imposts and Excises shall be uniform throughout the United States" - Congress embraces this duty but lumps way too many activities into the general welfare catch-all when it really means the general well-being or "life, liberty, and pursuit of happiness" within the country.

(2) "To borrow Money on the credit of United States" - this one they do exceptionally well.

(3) "To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes" - notice there is no language about within the borders of a State.

(4) "To establish a uniform Rule of Naturalization and uniform Laws on the subject of Bankruptcies throughout the United States" - amnesty for illegals is not a "uniform law" and allowing infiltration of illegals at our borders is contrary to a "uniform law."

(5) "To coin Money, regulate the Value thereof, and of foreign Coin, and fix the Standard of Weights and Measures" - the Fed is not mentioned and if were to be created to satisfy this provision, Congress would have total control and oversight and not the Executive.

(6) "To provide for the Punishment of counterfeiting the Securities and current Coin of the United States" - so why does the Treasury Department exist in the Executive branch?

(7) "To establish Post Offices and post Roads" - well so much for the post offices but a case can be made for the Interstate highway system to be construed as post roads, but here again the Department of Transportation is in the Executive branch. Notice that it says establish, which would include maintenance and expansion, It does not say review or monitor - an active, responsible role and not a passive or oversight one.

(8) "To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries" - this is specifically provides for patents and copyrights - not the funding of art or research. In fact, painting and other fine arts are not mentioned.

(9) "To constitute Tribunals inferior to the supreme Court" - another reason why they confirm all judicial appointments.

(10) "To define and punish Piracies and Felonies committed on the high Seas, and Offenses against the Law of Nations" - prosecuting the War on Terror falls within this.

(11) "To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water" - World war II was the last declared war and rules of conduct for the current campaign in the Middle East could stand to be clarified.

(12) "To raise and support Armies, but no Appropriation of Money to that Use shall be for a longer Term than two years" - meaning that one Congress cannot encumber another.

(13) "To provide and maintain a Navy" - notice the absence of language about funding limitations.

(14) "To make rules for the Government and Regulation of the land and naval Forces" - here again the War on Terror plus other deployments and foreign bases come to mind.

(15) "To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions" - illegal immigration, terrorism, drug trafficing, gangs, and other criminal activity along our southern border and seaboards would seem to be invasions.

(16) "To provide for organizing, arming, and disciplining, the Militia, and for governing such Part of them as may be employed in the Service of the United States respectively, the Appointment of the Officers, and the Authority of training the Militia according to the discipline prescribed by Congress" - full authority for the armed forces.

(17) "To exercise exclusive Legislation in all Cases whatsoever over such District (not exceeding ten Miles aquare) as may, by Cession of particular States, and Acceptance of Congress, become the Seat of Government of the United States, and to exercise like Authority over all Places purchased by the Consent of the Legislature of the State in which the Same shall be, for the Erection of Forts, Magazines, Arsenals, dock-Yards and other needful Buildings"  - provides for governing the District of Columbia and all federal installations.

(18) "To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof" - meaning that all Executive Orders and regulations of EPA, FCC, DOT, and other Executive Branch departments cannot have the force of law - only Congress has that authority.

In addition to these specific powers, the enabling clause in Amendments 13, 14, 15, 19, 23, 24, and 26 gives Congress "the power to enforce this article by appropriate legislation." The 16th Amendment gives them the "power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration" - but it says nothing about deductions, credits, exclusions or differential tax rates.

This is all Congress can do - nothing more. Amendment 10 underscores this - "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."

Let's hold Congress - and the President - accountable starting today.

The Constitution Returns To The House

Playing fast and loose with the Constitution for years, and really stretching any connection to the Constitution such as basing health care on the commerce clause when the health care bill specifically ignores interstate commerce, the 112th Congress will commence their session with the reading of the entire Constitution aloud for all of the Members of the House.

Of course that doesn't mean that they'll understand it - only that they will have heard it - and only for those who attend.

Then each time a bill is introduced, the Member must cite its Constitutional authority for that specific measure.

This is great in concept, but the legislators actually have to know what the Constitution says and what it allows them to do - very little actually - before this will work.

I expect a lot of bending will be done and that most of what is introduced will be for the "general welfare" even though that is a very minor concept and not specifcally covered in any of the specific powers of Congress.

Give them an A minus (A-) for effort - we'll see how it works.

Bill McCollum Gets It

Bill McCollum gets it. HR 3590 - government health care - is unconstitutional. It has been stince the first proposal was uttered a year ago.

If you don't know, Bill McCollum, patriot, is Attorney General of Florida. Today he followed through on his promise to sue the federal government over passage of the health care bill. Not only that, 12 other States joined the suit.

If the 17th Amendemnt had been repealed - or never passed - we might not be to this point because Bill Nelson of Florida would have been recalled. He originally voted for the Senate bill in the Finance Committee and then went on to vote for it in final passage would have been recalled.

Nelson wrangled a deal for Dade, Broward, and Palm Beach county seniors that Medicare Advantage - once it is discontinued - will still apply. This is what is know as the "Gatoraid" provision to go along with the "Cornhusker Kickback," the "Louisiana Purchase," and other sweetheart, backroom deals.

If both Nelsons were serving under the original provisions of the Constitution, intead of the 17th Amendment fix, they both would be gone. Many others would as well, and we wouldn't have had health care voted into existence.

So now McCollum has to get the courts to fix the work that could have been avoided had Bill Nelson listened to his constituents.

McCollum states, "This law represents an unprecedented encroachment on the liberty of the American people, and I will pursue this litigation to the highest court if necessary."

No Representation

Americans are incresingly feeling that their voice isn't being heard in Washington and that they aren't being represented. Wasn't this one of the charges against George III?

Three-fourths of Americans (75%) in a recent FoxNews poll feel that they are not being represented - as if we needed that survey to tell us this. All we have to do is reflect on our own experiences.

Whenever I call my Senators - especially Bill Nelson of Gatoraid fame - I only get voice mail. They aren't interested in hearing from us. My congressional seat won't be filled again unitl Ed Lynch wins the special election on April 13th.

I clearly have little to no representation.

The current numbers on people opposing health care are at 55% and rising. However, since the majority of votes in Congress is all that matters, and not whether they represent the will of the people, we may get health care passed anyway.

Even if it passes on Sunday or whenever, it isn't a done deal yet.

Oh, if November 2nd would get here.

Some Sanity In The Senate

No, don't get your hopes up. I'm not talking about Harry Reid. In fact. he has mouthed off again at something that actually is good.

Senator Jim DeMint has held up the confirmation of Erroll Southers to be the TSA Director. His concern - and rightfully so - is that the TSA might become unionized. This would seriously diminish the respect that the public has for this agency and the role that they play in the security of our nation.

Remember the Air Traffic Controllers Union in the Reagan days? Imagine that the TSA union decides to go on strike. Does all air travel cease? Or does TSA management step in to attempt to help out?

What if a union leader wants to apply the rules differently for certain people - say those who are members of the union or supporters of it?

We're talking trained screeners here. Anyone who can pass the background check can apply. This is not a technical, specialized job where only a limited number of people can apply and be accepted.

Thank you, Jim, for taking your Constitutional authority seriously on confirmations and for keeping unions out of the TSA. Unions have done more than enough to mess up the airline industry already.

At Least We Are Being Led By The Clueless

Someone asked Nancy Pelosi to explain by what Constitutional authority she was able to dictate to Americans that they have health care. Great question, by the way, and one that I have discussed previously.

Her answer was quite revealing.

Rather than tell the truth that there is no such Constitutional authority, she exclaimed. "Are your serious?"

Right back at you. Either you don't know the Constitution well enough to know the true answer to this question, or you were indignant that someone called you out on it.

Either way, it's nice to know that we are being led by a Congress that is being led by the clueless.

It's Time Congress Obeyed The Constitution

Cap and trade legislation, education reforms, health care, buyouts of American companies, and most of the other proposed and recently enacted bills of Congress are unconsitutional in my opinion. They are in direct violation of Article 1, Section 8 of the Constitution and Amendment X.

There are but 18 specific eneumerated duties of Congress. Over one-third of them (7) have to do with the military. That leaves 11 others. Two deal with coining money and conterfeiting. One with the Post Office. Another with trademarks and patents. One deals with maritime interests and piracy. One allows establishment of lower courts

The remaining five include (1) borrowing money using the credit of the United States, (2) creating uniform laws of naturalization and bankruptcies, (3) regulating commerce (international and interstate), (4) levying and collecting taxes, and (5) making the necessary laws to carry out the first 17 duties.

Congress has not declared war since December 8, 1941 although we have been involved in many battles since then in Vietnam, Korea, Bosnia, Grenada, Haiti, Cuba, Somalia, Panama, Afganistan, Kuwait, Iraq, and elsewhere. Also, Congress has not exercised its authority over prisoners of war.

Education is not an enumerated powere and therefore a states right. However, we have the Department of Education. The Constitution is silent on giving the government the power to bailout banks or loan money to public companies. It says nothing of health care.

The point is this. We have allowed - over the years and generations - our government to grow like a stage 4 cancer until it has assumed powers never intended or permitted and it is threatening to kill our American way of life as originally expressed through the founding documents.
