What Part Of "Illegal" Does The Government Not Understand?

Can you believe it? Illegal aliens with constitutional rights? That is an oxymoron of the highest proportion.

Today. the 9th Circuit upheld a conviction of Arizona rancher Roger Barnett for detaining at gunpoint (without shots fired) a group of illegals from Mexico on his property until the Border Patrol could arrive and arrest them.

He was found guilty of denying their rights by kicking them and yelling at them - they claimed assault and emotional distress.

This happened in 2004 on George Bush's watch. It's now 7 years later on Obama's watch. Not much has changed.

If you are in this country illegally, you have broken a major law. You cannot therefore be afforded any protection. End of story. Roger needs the conviction reversed and the $87,000 fine eliminated.

We keep giving lip service to border security, but no one in government - certainly not the President, or the Attorney General, or Janet Napolitano - seem at all interested in doing anything serious about it. This conviction is a shame and an affront to our system of laws.

More Senatorial Tricks

Today, the Senate passed a $600 million border security bill - small potatoes compared to what they usually vote on and pass.

Obama promises to sign it, but since he won't authorize the detaining of any illegals, this is all for show. Some 1,500 border guards are supposed to be hired in this program, but what can they do? Chuck Schumer, who sponsored the bill, claims that this measure gives Obama and Napolitano the "boots on the ground" to stem the tide of "crime and violence."

This at the same time the government is fighting to get Arizona's law on illegals thrown out because they don't want any laws against illegals enforced - and while Floirda is trying to pass an even tougher law than Arizona did.

So the Senate passed this feel-good measure to show that the government is serious about border security, but we know that they aren't since the border patrol has no real arrest power or the ability to use deadly force.

Here's the real kicker. Anyone who has ever served on a committee - student council, church, neighborhood association, little league, scouts, an on and on - knows that a legal, binding vote cannot be taken without a quorum. The quorum, unless specified to be a higher number is generally half plus one. In the case of the 100 member Senate, the quorum would be 51. Today's "vote" was a voice vote using the "consent agenda" provision, and the number present and voting was two.

Therefore, it was not a legal vote - unless the Senate has more arcane rules that allow such conduct.

So a bill that will do nothing but spend money was improperly authorized. Business as usual in the Senate.
